Even if Habba had her facts straight, the motion would have been frivolous. I appeared before the Federal Dist Ct Judge for whom I clerked . Many former clerks do the same, including before the SCOTUS. And there was no prohibition against appearing in front of Judges who had been with our firm. Beyond all that, the bios of both Kaplans were open and obvious . Pulling this nonsense after the trial is as bush-league as most of Habba's lawyering.
Although Law & Order is a fictional TV show, I think they strive to provide a smidgen of accuracy as to the legal side of things. There's a finite number of judges in NYC and a larger (but still finite) number of lawyers in NYC qualified to represent the defendants in these cases. Multiple judges make multiple appearances and various defense attorneys make repeat appearances. Somehow the judges, the lawyers, and Jack McCoy are able able to respectfully interact with each other despite of their familiarity with each other. Something Trump and Ali BlahBlah are unable to comprehend.
In the upside down world of Trump followers, all his setbacks are badges of honor, and he revels in them. Let’s hope the collective weight of his various adverse civil verdicts and likely criminal convictions take their toll and finally remove him from the scene
I read Habba's original letter which also raises the issue of Crowley's being a law clerk to Judge Kaplan as though that would be basis for appeal. Once lawyer Kaplan responds to Habba, Habba backed down. So i wonder why Habba raised Crowley as an issue in the first place? Clearly, unlike what Habba said on a show, it is more important to be smart (and educated in actual law) than pretty. Is it too late to punish Habba for wasting the court's time?
I don't feel like a good person for having this thought, but, gosh, it would be the very sweetest of wines if Trump wound up having to file for bankruptcy as a result of this.
Re Trump’s week ahead. Chris, it seems there are two penalties that can be exacted here: Monetary disgorgement and Not being able to operate a business in NYS. Are there different attributes to the case that might indicate towards one penalty or the other (or both)?
