If you had read the 93 page opinion, despite the misleading media alluding otherwise, Judge Cannon did not rule that Special Counsels were unlawful, but stated Biden and Garland follow the law in appointing one.
DOJ can either appeal to the 11th circuit, or have the US Attorney in Florida, DC, or even New Jersey (where Convicted Felon Trump hid some of the stolen documents) bring the case anew. There's no double jeopardy because jeopardy had not yet attached and the bogus dismissal was not based on Trump's guilt or innocence.
