It is insulting to those who have lost family members tragically when people the likes of Ben Carson or Marco Rubio say “God saved him” because he is a savior of sorts. What a joke. My grandson died tragically and he was a bright young man who was ready to do great things. It seems a real gut insult. Or the firefighter that was killed at the rally. Was he not deemed “good enough” in God’s eyes? I just wish i could scream 😱 as his luck continues

I agree. When I hear a person who had a brush with death but survived, say "God saved me" I bristle, and I've been known to say "Oh, so god thinks you're special?" Anyone self-absorbed enough to elevate themselves that way deserves my retort.

Judge Cannon's decision is ,in part, a result of the quiet revolution being led by the 6 right wing Justices on the SCOTUS. Consider the lengths to which the opinions in the SCOTUS's outrageous immunity ruling were written to protect Trump broadly. Roberts's majority opinion ventured unnecessarily into evidentiary issues and , thus, provided Trump's lawyers with an argument to dismiss the NY case. That effort may or may not work at the trial court level, but it has a good shot on appeal. Thomas's odd concurrence challenged the appointment of the SC, an issue neither presented nor briefed. That opinion served as an amicus brief and roadmap for the dismissal by Cannon, which rejected all prior precedent dating back to Watergate.

Canon’s ruling is the Jack Smith’s appointment was UNLAWFUL by the Appointment and Appropriations clause of the constitution.

Yes, I read it. Summarizing her ruling doesn’t make it right. She explicitly rejected contrary precedent. This type of challenge has been advanced in other cases. It’s been rejected, as she noted. Cannon evinced a hostility to the case from day one. She was rebuked by the 11th Circuit for her unprecedented actions regarding the review of materials from the search.

The law concluded that Biden & Garland's appointment of Smith as a Special Counsel was unlawful by violating our Constitution's Appointment & Appropriations clause. This means Biden & Garland violated the law while investigating their political opponent. If you had read the 93 page opinion, despite the misleading media alluding otherwise, Judge Cannon did not rule that Special Counsels were unlawful, but stated Biden and Garland follow the law in appointing one.

DOJ can either appeal to the 11th circuit, or have the US Attorney in Florida, DC, or even New Jersey (where Convicted Felon Trump hid some of the stolen documents) bring the case anew. There's no double jeopardy because jeopardy had not yet attached and the bogus dismissal was not based on Trump's guilt or innocence.

DoJ does not have these options. They unconstitutionally appointed a Special Counsel. Garland gave a citizen the unsupervised powers of a federal attorney to a private citizen. Then claimed to Judge Canon that Smith was an inferior officer which requires supervision and budget/staff rules. At the same time, he lied to Congress and the American by saying he doesn’t supervise or even coordinate with Jack Smith. This unconstitutional bubble has been busted.

You repeat Trump's talking points well, but special counsels have been appointed for more than a century going back to the 1800s. They have continually been upheld. What was unconstitutional was Cannon's bogus decision. DOJ absolutely can appeal and/or refile the case elsewhere.

I follow Glenn Kirschner's videos (he's a former Federal prosecutor) and he pointed out that they have the option of putting in ANY U.S. Attorney, not just the one(s) in Florida. And then that person could hire Jack Smith so nothing would be lost. But the announcement is that they're going to appeal.

against a former a president and current candidate needed independence. You are saying the DoJ can ignore its own determination of requiring a special counsel by finding a federal attorney in NJ or FL? Really?

False. First, neither independent or special counsels go back to the 1800s. Independent counsels were created post Watergate in 1978 and Special Counsels in 1999. Second, the process of shopping for a crime is unconstitutional. Third, I suppose they could appeal but we are talking about a major constitutional violation. Garland has said to Congress that he doesn’t coordinate with Smith while Smith is saying to a Federal Judge,”Hey, I am legit because I am an inferior officer under the supervision of Garland.” How do you walk back two years of unconstitutional behavior?

You can spin all you want. U.S. Grant appointed the first special counsel in 1875. And your touching concern about forum shopping is pretty funny considering this is exactly what MAGAts have been doing since Trump stacked the courts with extremists (see, e.g., the abortion pill case). The only "unconstitutional" act here is corrupt Judge Cannon's dragging her feet on the case for months and then abiding by dicta from equally corrupt Justice Clarence Thomas which was totally out of line given that the Supreme Court ruled more than a century ago that the Court does not give "advisory" opinions.

Trump's theft of top secret documents, his lying about them, and his obstruction of justice WILL be prosecuted.

So Jack Smith was unconstitutionally anointed a special counsel (just four days after President Trump announces his candidacy) for alleged crimes in 1.5 years earlier, but you are upset that a Federal Judge didn't grant the unlawfully appointed special counsel's request to fast track a case so that it would occur prior to the election? Your recommendation of trying to convict in FL or NJ is at odds with the justification given by Garland to appoint a special counsel. You are unwittingly undermining both your arguments. Intellectually, you are not grasping that Garland & Smith are talking out of both sides of their mouth. Garland's appointment states that Smith "will not be subject to the day-to-day supervision of any official of the Department," but then Smith is telling a judge, in order to be constitutional, hey I am actually an inferior officer. By law, an inferior officer, is subject to supervision. In sworn testimony, Garland stated that he has not supervised or even coordinated with Smith. Judge Cannon astutely points out that the manipulation of official appointments was the mark of English Monarchy. Let the facts be stated that Biden and Garland UNLAWFULLY appointed an officer to prosecute their newly announced political rival.

I - in jest- accused you yesterday of being a recidivist "prisoner of the moment," having been on all sides of the question of Joe's remaining on the ticket. But I concede that you've described this moment accurately. But as you correctly point out re Trump, the essential characteristics of these two have not changed, and the manner in which those characteristics manifest can change the moment. Trump will likely return to his hate-filled and hateful ways. Biden may rally and dispel concerns or may falter. To paraphrase an old saying, we are cursed to live in interesting and parlous times.

What a terrible day. Despite the recent setbacks (baby judge Loose Cannon throwing out the documents case, the execrable JD Vance being chosen as VP candidate) - we can't give up.

It's the most perverse gaslighting that Democrats are now blamed for telling the truth about Trump - that didn't cause a registered Republican to try to assassinate Trump. That said, Biden's "bullseye" comment was the worst gaffe ever, much worse than mixing up names. The Democratic party has done terrible damage by not putting forth an electable candidate. And Biden's continued refusal to step down and let someone who might win step in (Kamala? Newsom? Whitmer? Shapiro?) virtually guarantees Trump's win in November. And now Biden's campaign is largely on pause? Sheesh.

However, there are STILL actions we can take to reduce the odds of the GOP turning our country into an autocracy. Even if Trump wins, getting Democrats in the “lower” offices still matters.

Cannon's insane ruling today has NOTHING to do with "luck".

The fix was always in the moment that the hopelessly corrupt and unqualified Judge Cannon was assigned this case.

If any other person did what Trump did they would already be in prison for 10+ years.

MAGA judges, including the radical right wing majority of six GOP partisans on the Supreme Court, have upended the whole meaning of the Constitution and the rule of law.

America is on the precipice of a failed democracy.

I don't know why prosecuting Trump wasn't prioritized over the QAnon horns guy. Why not go after the shepherd who's a real threat rather than the sheep? Perhaps this was deliberate. They thought Biden could beat Trump but not a more mainstream candidate like Haley.
